This Privacy Policy describes how we, Brighter Vision Web Solutions, Inc. (“BVWS”), collect and use the personally identifiable information you provide on our Site and through the products and services purchased or accessed through this Site (individually and collectively, the “Services”). It also describes the choices available to you regarding our use of your personally identifiable information and how you can access and update that information.
1. INFORMATION COLLECTION AND USE
BVWS collects information about visitors to our Site and our customers so that we can provide an experience that is responsive to our users’ and customers’ needs. Information may be collected as part of: (i) fulfilling new account or information requests, (ii) purchasing Services, (iii) responding to communications from us (e.g., surveys, promotional offers, or Services enrollment confirmations), (iv) accommodating your personal preferences, (v) fulfilling requests for Services or recommendations we provide you, (vi) working with third party sources, including collecting information available from social networking and other web sites, to better assist us with understanding your interests and to serve you better, (vii) updating your contact information including your address (through such services as the National Change of Address Service in the United States), or (viii) facilitating the transmission of forward to a friend email at your request. The types of personally identifiable information that we collect may include your name, home, work and e-mail addresses, telephone, mobile telephone, and fax numbers, credit card information, date of birth, gender, and professional information necessary to fulfill special requests.
We may use your personal information to keep you updated about our products and services and send you promotional material about BVWS and, as permitted by applicable law, on behalf of our parent company, affiliates, subsidiaries, joint ventures, or other companies under common control with us (collectively, “Affiliates”) and partner companies.
In order to streamline certain business operations, develop products and services that better meet the interests and needs of our customers, and inform our customers about relevant products and services, we may share your personal information with any of our current or future Affiliates. You hereby provide explicit consent to our sharing some or all of your personal information with our Affiliates.
BVWS may also collect non-personally identifiable information about you, such as your use of our web sites, communication preferences, aggregated data relative to your Services, and responses to promotional offers and surveys.
Please note, to better safeguard your information, please do not include any credit card information in any electronic communications with BVWS unless it is specifically required by us as part of Services or transaction fulfillment process sites, or our customer contact process.
This Site and our Services may contain links to other websites. Unfortunately, BVWS is not responsible for the privacy practices or the content of such sites, including Supported Platforms defined below. Please review the sites’ respective privacy policies.
In particular, the various Services allow our customers to post their content to other third party services, including “Supported Platforms” such as Twitter, Facebook, etc. When our customers link a Supported Platform to their account, our customers can choose to instantly collect, process, share and access such third party services and Supported Platform via BVWS account (subject to the terms of the license agreements with the Supported Platforms and other third party services). Customers can create, input, submit, post, transmit, store, view or display personal information through the functionality in the Services. Such information can include personal information of all types, including but not limited to user generated content (such as messages, posts, comments, pages, profiles, images, feeds or communications exchanged on the Supported Platforms).
This Privacy Policy does not cover any information posted or otherwise generated by a customer or other content a customer can view via the Services on the Supported Platforms.
2. SECURITY
This Site has security measures in place to protect against the loss, misuse or alteration of the information under our control. We follow generally accepted standards to protect the personal information submitted to us, both during transmission and once we receive it. No method of transmission over the Internet, or method of electronic storage, is one hundred percent (100%) secure, however. Therefore, we cannot guarantee its absolute security.
3. EMAILS
We may use emails to communicate with you, to confirm your placed orders and enrollment in the Services, and to send information that you have requested. We may also provide email links to allow you to contact us directly. We strive to promptly reply to your messages.
The information you send to us may be stored and used to improve this Site, the Services, our others products, or it may be reviewed and discarded.
4. THIRD PARTY SERVICE PROVIDERS
We may at times provide information about you to third parties to provide various services on our behalf, such as processing credit card payments, serving advertisements, conducting contests or surveys, performing analyses of our products or customer demographics, shipping of goods or services, and customer relationship management. We will only share information about you that is necessary for the third party to provide the requested service. These companies are prohibited from retaining, sharing, buying, selling, storing or using your personally identifiable information for any secondary purposes. When you enter sensitive information (such as a credit card number) on such third party order forms that we utilize, your information will be encrypted using secure socket layer (“SSL”) technology provided by the third party payment or service provider.
In order to provide certain Services to you, we may on occasion supplement the personally identifiable information you submit to us with information from third party sources (e.g., information from our strategic partners, service providers, or the United States Postal Service). We do this to enhance our ability to serve you, to tailor our products and services to you, and to offer you opportunities to purchase products or services that we believe may be of interest to you.
5. GOOGLE ANALYTICS AND COOKIES
We may use tools such as Google Analytics or Clicky.com to collect information about use of this Site, such as how often users visit the Site, what pages they visit when they do so, and what other sites they used prior to coming to this Site. Google Analytics collects only the IP address assigned to you on the date you visit this Site, rather than your name or other identifying information.
Google Analytics plants a permanent cookie on your web browser to identify you as a unique user the next time you visit this Site. This cookie cannot be used by anyone but Google, Inc. The information generated by the cookie will be transmitted to and stored by Google on servers in the United States.
We use the information received from Google Analytics only to improve services on this Site. We do not combine the information collected through the use of Google Analytics with personally identifiable information.
Google’s ability to use and share information collected by Google Analytics about your visits to this Site is restricted by the Google Privacy Policy. You can prevent Google Analytics from recognizing you on return visits to this Site by disabling the Google Analytics cookie on your browser.
We also use one or more pieces of tracking code or “cookies” in order to provide improved services to our users. Cookies are stored by your web browser on your computer’s hard drive to assign a unique identification number or code to your device. We do not store personal or private information in any cookies. We may use cookies to help direct you to the appropriate location of our web site, by noting that you have previously visited our website.
You may delete or block BVWS’s cookies through your browser’s cookie manager. This function is usually found in the preferences section of your web browser. If you do not want BVWS or other websites to use cookies, you may disable them altogether from within your browser. Some parts of our website do not require cookies to be functional. It is important to note that disabling cookies or deleting them will disable auto-login, may reset your immediate session, and may adversely affect other functionality offered on our website and Services.
6. SERVICES TERMINATION
When your Services are cancelled (either voluntarily or involuntarily), all of your personally identifiable information is placed in “deactivated” status with our third party billing partners and on our relevant BVWS databases. However, deactivation of your account does not mean your personally identifiable information has been deleted from our database entirely. We will retain and use your personally identifiable information as necessary in order to comply with our legal obligations, resolve disputes, or enforce our agreements.
7. COLLECTION AND USE OF PERSONAL INFORMATION OF CHILDREN UNDER AGE 13
BVWS is committed to protecting the online privacy of children. In accordance with the Children’s Online Privacy Protection Act (”COPPA”), BVWS will not knowingly collect any personally identifiable information from children under the age of thirteen (13) without first obtaining parental consent. Prior to providing any personally identifiable information (your name, email address, address, phone number etc.), children under the age of thirteen (13) must have a parent or legal guardian complete and return (by email or regular mail) a Parental Consent Form to [email protected] or Brighter Vision Web Solutions, Inc., ATTN: Legal, 2569 Park Ln, Suite 200, Lafayette, CO 80026. The consent form states that the child’s “Parent” or “Legal Guardian”, by his or her signature, consents to the collection and transfer of the child’s personally identifiable information. Consent may be revoked by completing a “Revocation of Parental Consent Form” and sending it to the email or physical mailing address above. In compliance with COPPA, BVWS is sensitive about children consulting with parents or guardians before furnishing personal information or ordering anything online.
It is also BVWS’s intention to adhere to the Children’s Advertising Review Unit (CARU) Guidelines on Internet advertising with its special sensitivities regarding solicitations to children under thirteen (13). BVWS encourages parents/guardians to supervise and join their children in exploring cyberspace.
8. TRANSFER AND STORAGE OF DATA ABROAD
We do not intentionally offer, market, target, or direct our products to people living in the European Economic Area. However, If you are visiting this Site from a country other than the country in which our servers are located, your communications with us may result in the transfer of information across international boundaries. By visiting this Site and communicating electronically with us, you consent to such transfers.
9. COMPLIANCE WITH LAWS AND LAW ENFORCEMENT
We cooperate with government and law enforcement officials and private parties to enforce and comply with the law. We will disclose any information about you to government or law enforcement officials or private parties as we, in our sole discretion, believe necessary or appropriate to respond to claims and legal process (including without limitation subpoenas), to protect our property and rights or the property and rights of a third party, to protect the safety of the public or any person, or to prevent or stop activity we consider to be illegal or unethical. We will also share your information to the extent necessary to comply with ICANN’s rules, regulations and policies.
To the extent we are legally permitted to do so, we will take reasonable steps to notify you in the event that we are required to provide your personal information to third parties as part of legal process.
10. CHANGES IN OUR PRACTICES
We reserve the right to modify this Privacy Policy at any time. If we decide to change our Privacy Policy, we will post those changes to this Privacy Policy and any other places we deem appropriate, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it.
If we make material changes to this Policy, we will notify you here, by email, or by means of a notice on our home page, at least thirty (30) days prior to the implementation of the changes.
11. UPDATING YOUR INFORMATION
You may alter, update or deactivate your account information or opt out of receiving communications from us and our partners at any time. We will respond to your request for access or to modify or deactivate your information within thirty (30) days.
12. HIPAA DISCLAIMER
We are not “HIPAA compliant.”
You are solely responsible for any applicable compliance with federal or state laws governing the privacy and security of personal data, including medical or other sensitive data. You acknowledge that the Services may not be appropriate for the storage or control of access to sensitive data, such as information about children or medical or health information. BVWS does not control or monitor the information or data you store on, or transmit through, the Services. We specifically disclaim any representation or warranty that the Services, as offered, comply with the federal Health Insurance Portability and Accountability Act (“HIPAA”). Customers requiring secure storage of “protected health information” as defined under HIPAA are expressly prohibited from using the Services for such purposes. Storing and permitting access to “protected health information” is a material violation of this Agreement, and grounds for immediate account termination. We do not sign “Business Associate Agreements” and you agree that BVWS is not a Business Associate or subcontractor or agent of yours pursuant to HIPAA. 13. BRIGHTER VISION PAYMENTS SERVICES
In connection with the Brighter Vision Payments Services, BVWS uses the payment processing services of WePay, Inc. (“WePay”). If you elect to use WePay’s services, BVWS will collect the following information and share it with WePay: first name, last name, email, business name, business description, phone number, business URL, billing address, and a description of the payment. WePay’s use of this information is subject to their privacy policy located at: https://go.wepay.com/privacy-policy/.
14. MERGER CLAUSE
This Privacy Policy, our Terms of Service and the Service Level Agreement contain the final, complete and exclusive statement of the agreement between the BVWS and You with respect to the Services and transactions contemplated thereunder. All other prior or contemporaneous oral communications and agreements, and all prior written communications and agreements with respect to the subject matter hereof are merged herein and superseded. In the event that the terms of this Agreement and the Privacy Policy and/or Service Level Agreement conflict, the terms of this Agreement shall prevail.
